Terms of Service

These terms govern access to and use of the MySMS API service, operated by BRAKHA INTER SARL. Creating an account or making any API call constitutes acceptance.

1. Purpose of the service

MySMS API provides an application programming interface for sending and receiving SMS and WhatsApp Business messages, and for tracking their delivery. The service is reserved for business use.

2. Account and security

• An account is opened from the service's registration page, or on request to the platform administrator. The holder is responsible for the confidentiality of their credentials and of the access tokens issued.
• Any action carried out using your credentials is deemed to originate from you.
• You must notify us without delay of any suspected compromise.

3. Obligations relating to messages sent

You are solely responsible for the content you transmit and for the recipients you designate. In particular, you undertake to:

• hold the prior consent of recipients, as required by WhatsApp for any business message;
• honour any opt-out request without delay;
• refrain from sending unsolicited, misleading, fraudulent or unlawful messages, or messages infringing the rights of third parties;
• comply with the WhatsApp Business Messaging Policy and with the regulations applicable to electronic communications.

Failure to observe these rules may result in immediate suspension of the account, as well as sanctions imposed directly by Meta against the business number, up to permanent deactivation.

4. Credits and billing

• Each account holds two separate, non-convertible wallets: an SMS balance and a WhatsApp balance.
• SMS are counted per message segment.
• WhatsApp is billed per conversation: opening a 24-hour window is counted once, and every message exchanged during that window is included.
• Credits are prepaid, non-refundable and do not expire, except on closure of the account.

5. Availability

The service is provided without any guarantee of uninterrupted availability. Message delivery depends on third-party carriers — Meta and telephone operators — whose delays, rate limits and possible failures are beyond our control. Acceptance of a message by the platform does not constitute a guarantee of delivery.

6. Usage limits

• API calls are rate-limited; circumventing that limit is prohibited.
• Meta applies its own business messaging caps, which may change according to the observed quality of your number.
• Outside the 24-hour window, only message templates approved by Meta may be sent.

7. Liability

Our liability is limited to the amount of credits actually purchased during the twelve months preceding the triggering event. Indirect losses are excluded, in particular loss of revenue, of customers or of data. Nothing in these terms excludes liability that cannot lawfully be excluded.

8. Suspension and termination

We may suspend or close an account in the event of a breach of these terms, of abusive use, or on the order of a carrier or an authority. You may request closure of your account at any time; the deletion procedure is set out on the Data deletion page.

9. Personal data

The processing of data is described in our privacy policy, which forms an integral part of these terms.

10. Changes

These terms may be amended. Any substantial change is notified to account holders at least fifteen days before it takes effect. Continued use of the service constitutes acceptance.
